Dotta – Terms of Service

Welcome to Dotta (“the App”), an iOS application developed by PermaEvidence SA, a company based in Costa Rica (“we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of Dotta. By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, you must not use the App.


1. Overview of the Service

1.1 Description

Dotta is an AI chat application that allows users to interact with a large language model (“LLM”) via text or voice. The App does not maintain its own server; user data, including conversation history and credits, are stored solely on the user’s device.

1.2 Third-Party Services

Because Dotta relies on these third-party services, we cannot guarantee that they will continue to work at all times or for any specific duration.


2. Purchasing and Using Credits

2.1 In-App Purchase

You may purchase credits within the App using your Apple ID account. These credits are stored locally on your device.

Each prompt you send and each audio transcription you request will deduct from your available credits until all credits are used.

2.4 No Redemption Guarantee

PermaEvidence SA makes no representations or warranties as to the ongoing redeemability of these credits. The user acknowledges that they may lose the credits if the App or third-party services are discontinued or become unavailable for any reason.

2.5 User Responsibilities

You are solely responsible for maintaining a credit balance you are willing to forfeit at any time. By using or purchasing credits, you accept the inherent risks of local storage (e.g., loss, phone damage, phone reinitialization) and acknowledge that it may be impossible to recover lost credits.


3. Service Limitations and Disclaimer

3.1 No Warranty of Availability

We do not guarantee that the App or any part of the services provided through third-party providers (e.g., Groq Inc. or Openrouter) will always be available or operate without interruption. The service may be subject to limitations, delays, or other problems inherent in the use of the internet and electronic communications.

3.2 Third-Party Reliance

Since Dotta relies on third-party services for transcription and LLM responses, PermaEvidence SA cannot ensure the continued operation or maintenance of these external services. Any failure or discontinuation of third-party services may result in the partial or complete unavailability of the App’s functionality.

3.3 Potential Discontinuation

We reserve the right to discontinue the App at any time, for any reason, without notice or liability to you. If discontinued, any remaining credits cannot be refunded or transferred because of the App’s local storage model. The user waives any right to a refund.

3.4 No Liability for Data Loss

PermaEvidence SA is not liable for any loss of data, including but not limited to credit balances and conversation histories, due to device failures, accidental deletion, or any other reason.


4. User Conduct and Obligations

4.1 Appropriate Use

By using Dotta, you agree not to misuse the services or encourage or enable others to do so. Prohibited actions include, but are not limited to, any use in violation of applicable law, or use intended to harass or harm others.

4.2 User Responsibility for Data

All conversations and user data are stored solely on your device. You are fully responsible for managing and securing your device’s data. We have no access to or control over your local data and assume no liability for its content or loss.

4.3 User Content and Conduct

You are solely responsible for all content, communications, and materials you create, upload, or transmit via the App (collectively, “User Content”). This includes any text, images, or other media. You agree:

Furthermore, you assume full responsibility for the legal consequences arising from your User Content. You understand and agree that you will be solely responsible for any claims, damages, liabilities, or suits brought against you by third-party API providers or any other third parties in relation to your User Content. You expressly release the App creators, developers, owners, and affiliates from all liability related to such claims or disputes.


5. Intellectual Property

5.1 Ownership

All intellectual property rights in and to the App, including any updates, enhancements, and new features, are owned by or licensed to PermaEvidence SA. You are granted a limited, non-exclusive, non-transferable license to use the App under these Terms.

5.2 Third-Party Content

Any third-party content accessible through the App remains the property of the respective third-party owner. Your use of such content is subject to the applicable terms set forth by the third-party provider.


6. Limitation of Liability

6.1 No Liability for Loss of Credits or Service

To the maximum extent permitted by law, PermaEvidence SA shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with your use of (or inability to use) the App or any related service. This includes, without limitation, damages related to loss of credits or loss of access to third-party services.

6.2 Disclaimer of Warranties

The App and all related services are provided “as is” and “as available,” without warranty of any kind, whether express or implied, including, without limitation, the warranties of merchantability, fitness for a particular purpose, and non-infringement.


7. Indemnification

You agree to indemnify, defend, and hold harmless PermaEvidence SA, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees arising out of or relating to your violation of these Terms or your use of the App.


8. Termination

8.1 Termination by You

You may stop using the App at any time by uninstalling it from your device. Any remaining credits will be lost upon uninstallation.

8.2 Termination by Us

We reserve the right to suspend or terminate your access to the App at any time, for any reason, without notice, including but not limited to a violation of these Terms or discontinuation of the App.

8.3 Effect of Termination

Upon termination (by you or us), you will lose access to all features of the App, including any stored credits, and no refund or other compensation will be provided.


9. Governing Law

These Terms and any disputes arising out of or in connection with these Terms or the App will be governed by and construed in accordance with the laws of the Republic of Costa Rica, without regard to its conflict of law provisions.


10. Changes to the Terms

We reserve the right to modify or update these Terms at any time. If we make material changes, we will provide notice within the App or through other appropriate means. By continuing to use the App after any changes come into effect, you agree to the revised Terms.
